User Agreement
This User Agreement (the ‘Agreement’) is related and is fully applicable to NAV Global’s website, community and other products and services. Do spare a few moments to carefully read the terms and conditions of this agreement before you begin to access our website, along with the experience & use of our products and services. This agreement shall be legally binding and constitutes a legal document which regulates the rights and obligations between you and NAV Global FZCO and its affiliated companies (herein after referred to as “NAV Global” or “we” or “us”).
I. Agreement Overview
1.1 The agreement contained here includes: the intellectual property rights and privacy protection, termination of services, liability exemption, legal liability, application of law, jurisdiction, information feedback, notification service, etc. While trying to access or use our products or services, it is important that you shall also comply with our other related agreements (if any) for example Use of Cookies, Terms of Sales, Community Terms and Rules, etc. If for any reason, you do not agree or refuse to accept the contents contained herein, please do not access, experience or use in any other way our products or services. We shall not be liable in any way if you continue to use our products or services.
1.2 Also note, at any given point of time in the future this agreement may be amended by NAV Global, but any such amendments made are directed at providing better services to you or are made in accordance with mandatory provisions of complete laws and regulations. Occasionally, the amendments to the wording of this agreement may be made in order to enhance the legibility. If any amendment is made to this agreement which abates your rights or interests, NAV Global will notify you via the contact details that you have provided or through a public announcement. It is important to note that, if after receiving the above amendment, you continue to use NAV Global products or services, you will be deemed to have known such agreement and agree to be bound by its terms thereof.
1.3 NAV Global’s products and services are structured and targeted towards adults. If you are a minor and wish to use our products and services, please gladly do so after the consent of your parents or legal guardian.
II. Intellectual Property Rights and Privacy Protection
2.1 All intellectual property rights in the NAV Global website, including but not limited to copyright to software, and any imagery, shall vest solely with NAV Global. NAV Global shall own all the intellectual property rights of the whole content of NAV Global’s network platform, except for the contents to which you enjoy copyright under relevant law. NAV Global also owns or has obtained legal authorization of all design drawings involved in NAV Global network platform and NAV Global account and other drawings, products and service names. Under no circumstances, you may duplicate, issue, exhibit, translate, compile or through information network spread, the above drawings, products, and service names, or use the same for any purpose and require NAV Global’s prior written consent in any such case.
2.2 NAV Global values your privacy to the highest standard and will do everything in our means to protect your privacy to the upmost regard. Also, any matters related to the privacy policy protection shall be addressed in accordance with NAV Global’s Privacy Policy.
III. Disclaimer
3.1 NAV Global explicitly disclaims all warranties with respect to the accuracy, truthfulness and most importantly completeness of any information contained on the NAV Global site. If anyone decides to take any action based on the above mentioned “information”, they shall be solely responsible for distinguishing the accuracy and truthfulness of such information and shall be responsible for taking reasonable measures to mitigate any such risk. We shall in no way whatsoever, be held accountable for the consequences arising from your acts. However, NAV Global will deal with the said information as soon as practicably possible upon discovery. NAV Global shall in no way be held liable for any kind of losses, punitive damages or other damages arising from or relating to the use of the website not directly associated with NAV Global, whether direct, indirect, accidental, special, and consequential or any other kind.
3.2 Given the special nature of internet services, you understand and agree that in none of the following circumstances shall NAV Global be held liable for your losses (including but not limited to property loss, earning loss, loss of data, etc., or other tangible losses):
3.2 (A) If NAV Global systems fails and are unable to operate due to an event of force majeure, like coup, war, terrorist attacks, strikes of workers, power failure or any natural calamities like earthquake, tsunami, flood, coup etc.
3.2 (B) If the NAV Global platforms are suspended or delayed under any cyber-attack, due to a computer virus set forth by any hacker, Trojan horse or any other malicious programs.
3.2 (C) If the NAV Global platforms are suspended or delayed due to technical adjustments or malfunctions or system maintenance of the telecommunications departments and network operators or delayed, suspended or terminated due to change of laws, regulations and other rulings of judicial authorities, or administrative departments etc.
IV. Liability for Breach of Contract
4.1 If it is brought to our attention or in case of received complaints or reports that you have violated any provisions of this agreement, NAV Global shall, without prior notice and at any time, have the right to delete or thwart the relevant information that you published or uploaded. Depending on the severity of circumstances, NAV Global reserves the right to take strict action against you, not only limiting to warning, account restriction or cancellation, or prohibition of your use of all or part functions or other appropriate actions such as proving public warnings. You will be solely responsible for any related losses or damages.
4.2 If any of your acts demeanor the company’s reputation in a negative way, including direct or indirect losses, third party penalties, claims, etc. NAV Global shall have the full right to seek indemnity for any such losses incurred.
4.3 If any dispute arises between you and a third party due to any of your violation of the provisions of this agreement, only you shall be solely responsible for all related consequences and indemnify and hold NAV Global innocent of any malpractices. Under no circumstances NAV Global is obligated to assist you in settling any such disputes or to reach any kind of settlement.
4.4 Limitation of Liability: For any kind of loss (irrespective of the kind of loss), you may have suffered in the course of your use of your NAV Global account, under no circumstances shall NAV Global be held responsible for damages in excess of the price you have paid to NAV Global, unless otherwise expressly provided for under applicable laws or regulations.
V. Applicable Law and Dispute Resolution
5.1 After the issuance of this agreement, including its execution, performance or lack thereof, interpretation or the settlement of related disputes shall be governed by the laws of Switzerland, without regard to the conflict of law provisions. If any conflict arises between a provision of this agreement and laws and regulations, the laws and regulations shall prevail. If a provision of this agreement is held invalid, the validity of the remaining provisions hereof shall not be affected.
5.2 If any dispute arises due to the performance of this agreement, it shall be settled by parties through a friendly discussion. If no settlement can be reached though consultation, either party may bring a claim before a court of competent jurisdiction in Switzerland.
VI. Information Feedback
6.1 Any important information may be sent to you from NAV Global via e-mail, mobile phone numbers, mailing address and other contact details you may have provided, or by publishing such information through the NAV global platform. Any information sent through electronic communication modes shall be deemed as effectively provided at the time received on your electronic equipment. Information sent by courier shall be deemed as effectively given on the third day after being sent by the courier service.
